DEMAND JUSTICE STATEMENT ON SUPREME COURT’S REPUBLICAN JUSTICES OVERTURNING ANOTHER DECADES-OLD PRECEDENT

WASHINGTON, DC––Christopher Kang, Chief Counsel of Demand Justice, released the following statement Friday after the Supreme Court, in a 5-4 decision along partisan lines, overturned a 34-year-old precedent in the case of Knick v. Township of Scott, Pennsylvania:

“This ruling is the second in barely a month to overturn a precedent more than three decades old. It clearly shows the Republican justices’ pattern of overturning past rulings simply because they believe they were wrongly decided. It also confirms that Justice Kavanaugh was not truthful when he told Senator Susan Collins that disagreement with a precedent would not be sufficient to overturn it.

“Justice Kagan’s dissent amplifies Justice Breyer’s alarm last month that the Roberts Court is a runaway court from which no precedent is safe.

“Every precedent that these Republican justices disagree with is unmistakably at risk, from Roeto Obergefell. Democrats must respond with structural reforms to the Supreme Court that can wrest back its balance and legitimacy.”
