DEMAND JUSTICE STATEMENT ON SUPREME COURT’S REPUBLICAN JUSTICES OVERTURNING 40-YEAR-OLD PRECEDENT
WASHINGTON, DC––Brian Fallon, Executive Director of Demand Justice, released the following statement Monday after the Supreme Court, in a 5-4 decision along partisan lines, overturned a 40-year-old precedent in the case of Nevada v. Hall:
“The Republican justices’ disregard for precedent proves that this Supreme Court is a runaway institution in dire need of reform. Justice Breyer’s dissent is a red alert that no Court precedent, however many decades old, is safe.
“This time, the Republican justices’ willingness to trample precedent concerned interstate sovereign immunity. Next year, it could easily make a casualty of Roe.
“It is no longer enough for Democrats to simply bemoan this trend. Democrats need to support plans to reform the Court if we ever hope to restore its balance and legitimacy.”
